An essential study of the work of U.S. Supreme Court Justice John Marshall Harlan (1833-1911). Many aspects of his dissents gained majorities after his death, as shown in the Civil Rights Cases (1883) and Plessy v. Ferguson (1896). His interpretation of "due process" contributed to the development of the incorporation theory.
